Many of us here a pretty much pro-police, but this type of incident will do more harm to police relations with the black community than you can imagine. We're not talking about a car thief, dope dealer, or armed robber not doing exactly what they're told, we're talking a marching band director playing music.

I'm surprised Al Sharpton and his posse (Jesse Jackson, Maxine Waters, The Squad) haven't already burnt down half of the city. This Tackleberry police mentality cannot continue.


 
That's crazy. My parents bought their first house in Minor many years ago and lived there when my brother and I were born. They moved to Auburn after my dad was transferred.
 
Mixed opinion on this one. It sounds like the LEO's went a little overboard but when the director was ask to stop he seemed to ignore and even taunt them. Many police related incidents could be avoided if people would just follow directions. The home team director followed request to stop while the visiting director did not comply and possibly resisted arrest. I do not think this was the crime of the century but sometimes you get what you ask for. JMO.

Which begs the question, what authority did the police have to ask the band director to stop?
 
Disturbing the peace, inciting a riot, failure to comply with LEO's, trespassing, request from venue owners, endangering the public, possible after hour noise violation (conjecture), curfew violation (conjecture), fire code egress violation (conjecture), terms of contract with PD concerning security at this venue (conjecture), to name a few probable causes. You would have to ask the Birmingham PD I don't know their motivation. The article stated the PD needed (wanted?) to clear the venue.

Disturbing the peace does not fly because the football game itself made a lot of noise beforehand. Nothing in the news report indicates anyone from the school district or school told the cops to get them to leave the stadium.
 
Ask the Birmingham PD I was not there and I don't think anyone on this site was either. Questioning if the PD had the authority to request them to stop playing , yes they did. If for no other reason they could have perceived a public safety issue. I do not know the details of the venue, jurisdiction, county, city or if anyone from the school ask for help. I will choose to wait on the details before I condemn the PD based on half information from the biased media. It seems a lot of folks jump on LE with both feet convicting them before the facts are out based on media hype. Yet theses same folks will swear the media is corrupt and biased if the information does not support their views on say political candidates. The bottom line is I really don't care why they ask this guy to stop.
 

There's a youtube video of this incident. No doubt about it, the cops are black and were upset about "being disrespected" so they zapped him with a taser. Nothing gives the black community the warm and fuzzies like the cops tasing an unarmed man in front of hundreds of witnesses.

Birmingham has dope dealers, car thieves, murderers and serious riff raff they could be tasing, but instead they tase an unarmed black high school band teacher. I look for Merrick Garland and Joe Biden to make it to Birmingham Alabama to stir up the black folks even more. Add a little more fuel to the fire. Just wait and see.

While the police have certain emergency powers they can use in crises situations, they can't just make up the law as they go. To force the band director to stop playing they would have to be enforcing an existing law or be reacting to a state of emergency or public safety situation.

So what really happened?

“High school bands in Birmingham City Schools are instructed to exit the stadium as soon as possible at the conclusion of high school football games. As a safety precaution, fifth quarter performances are not allowed,” said Birmingham City Schools, the district P.D. Jackson-Olin High School is part of.

So is this an actual ordnance? Do the police have the authority to enforce this? I suspect this is what the case will hinge on. Even such, tazing seems like excessive force for the situation.

It's more than likely a school board policy.
 
Personally I think it was an excessive use of force but part of me equates it to when LE instructs anyone to do something yet the person doesn't comply. I'm sure the band director was caught up in the emotions of the game and felt like he was just performing his job but when LE seriously instructs you to do something it's best to comply and deal with it afterwards. It's much less painful that way.

Agreed, but the band director did have the band stop playing. So why did the police still pursue it? It was that one officer who was pissed because the band director "disrespected" him.
