A liberal-led push to overhaul the Electoral College could be moving from the op-ed pages to the courtroom, as a Harvard professor who flirted with a dark-horse Democratic presidential bid last year vows litigation to change the system.

The article points out that out of the last three presidents, two lost the popular vote, but won because of the electoral college. Those two presidents happened to be Republicans. There's no doubt in my mind the Democrats would have a problem with the electoral college had those two candidates been Democrats. In fact it would be most likely they would be saying, "The system worked as the Founding Fathers had intended."

The guy who plans to file the suit to change the electoral college is hoping the courts will tell the states they must award electoral votes proportionately to how the congressional districts in their state voted rather than a winner take all. Two states do award their electoral votes by the districts the presidential candidate received the majority of votes. Personally I think it would be wrong for a court to tell the states how to award their electoral votes because the Constitution pretty much left it to the states to decide.

If this does go to the courts, he will most likely choose the most liberal ones. This would end up going to the SCOTUS.

It will keep them filled with anger for sure as it's very easy to keep them angry. I do think this guy filing suit is serious and believes the courts will side with him. The article states he hasn't decided which states to file this. I say when he does file California, New York, and Massachusetts are on the list.

How can the courts change the constitution? They can only interpret it, and I fail to see how they can read that any differently.

They can't. What he's hoping for is the courts tell the states they have to award the electoral votes proportionately. Now could you imagine if the states all awarded their electoral votes proportionately how difficult it could be for a candidate to get the necessary 270 to win? The House would decide who among the three candidates receiving the most electoral votes will be president. Imagine if that were the case last year. Only two candidates were awarded electoral votes; Trump and Clinton. The Senate would elect the vice-president. Who would the House have picked?
