Ruth Bader Ginsburg has died

It's being reported RBG's last wish was that a new justice not be appointed until a new president is elected. All the Democrats are saying a new justice should not be appointed until a new president is elected. Are they saying if Trump is re-elected the seat should remain open?

"The American people should have a voice in the selection of their next Supreme Court Justice," Schumer tweeted Friday. "Therefore, this vacancy should not be filled until we have a new president." I have news for you Chuck; the American people elected Donald Trump. The people who elected Donald Trump expect the seat to be filled as quickly as possible.

I read an article stating there is no longer a filibuster in the senate for judicial appointments. I see no reason why the seat can't be filled prior to the election.
 
Ted Cruz brings up a good point on why a new justice should be appointed prior to the election.

I agree with Ted.

And I do think it possible to get a nominee confirmed in 7 weeks if the GOP will stick together.
 
Looks like Trump will try to push one through, and it sounds like McConnel is on board.


My prediction is that Trump will nominate a woman, for no other reason but to try and avoid another Cavenaough type debacle where the Dems march out a list of women who were sexually assaulted by the nominee. I'm not a fan of identity politics, but I see it coming. I think the Hispanic woman is likely too.
 
Trump would be an idiot to not pick a woman. He is well known for shooting himself in the foot but I just can't imagine he could be dumb enough to not pick a woman. It is sad that it would matter but that's the way it is right now.
 
From what I've been hearing, if the SCOTUS replacement happens before the election, the dems will be disheartened and won't show up at the polls quite as strongly. If the position is still vacant on election day, they will be energized to show up at the polls to vote in Biden and whomever is pulling his strings.

I think that the vote could be close enough for a number of senators to look for some type of compensation for the 'Deciding" vote,,, this will likely get very sleazy.
Murkowski and Collins do have a point. The GOP held up Obama's pick to replace Scalia for 8 months! A month and a half this go round is not unfair,,, but I want another conservative justice! The dems are going to bitch about it no matter what happens,,, so let 'em.

That's who I think he should pick. She's conservative and from Florida, which will help him there. She's also a Cuban-American and if the Democrats taking part in the confirmation hearing go on the attack with her, all their candidates to include Biden get hurt in the process.

According to sources, Trump plans to hold the office of President and Supreme Court Justice at the same time. Citing his experience as a judge for Miss Universe as well as his time on The Apprentice, Trump is promising to make it "look easy."

Actually, they don't have a point. The "Biden rule" is that the senate won't hold a vote on a SCOTUS nominee in an election year when the president is in a different party from the senate majority. That's what happened with the Merrick nomination. This is not case now, so according to 1992 Biden (and the constitution), there is nothing to prevent the senate from voting.

Also, the GOP can afford a few defections. There only needs to be 50% plus one to confirm a nominee. There are 47 democrats, so the republicans need 47 for a tie, which would be broken by VP Pence. Romney and the Squish Sisters can bail on the vote, and a nominee can still be confirmed. (As long as they don't vote NO).
