I agree that if a person has had Covid and can produce the results of a recent anti-body test, then they should be exempt from having to have a Covid vaccine.

The case the judge cited was Jacobson vs Massachusetts in 1905. Massachusetts was experiencing a small pox outbreak that was related to the influx of immigrants who had recently arrived from several different countries in Europe. Jacobson was a Swedish immigrant who claimed he and his son had received the small pox vaccine in Sweden and had bad reactions to it. The small pox vaccine the state issued did say if a person was "unfit for the vaccine" they would be exempt. Jacobson could neither produce medical documentation he and his son had already received the vaccine in Sweden, nor any medical documentation showing he and his son had severe reactions to the vaccine. Justice John Marshall Harlan delivered the decision that upheld Massachusetts small pox mandate. The Court held that "in every well ordered society charged with the duty of conserving the safety of its members the rights of the individual in respect of his liberty may at times, under the pressure of great dangers, be subjected to such restraint, to be enforced by reasonable regulations, as the safety of the general public may demand" and that "[r]eal liberty for all could not exist under the operation of a principle which recognizes the right of each individual person to use his own [liberty], whether in respect of his person or his property, regardless of the injury that may be done to others."
 
Airlines can't operate without pilots. Airlines seem to always cave to pilots... however strikes have put many an airline out of business over the past 50 years.

URGENT: A Southwest Airlines pilot explains why you will not hear anything about vaccine mandates from his union - and why Southwest has more flexibility than it admits to stand up to the White House

The pilot emailed following the first Southwest post today (and provided his SWA ID to prove his identity). He asked that I paraphrase the email.
Essentially, the union cannot organize or even acknowledge the sickout, because doing so would make it an illegal job action. Years ago, Southwest and its pilots had a rough negotiation, and the union would not even let the pilots internally discuss the possibility of working-to-rule (which would have slowed Southwest to a crawl).
But at the moment the pilots don’t even have to talk to each other about what they’re doing. The anger internally - not just among pilots but other Southwest workers - is enormous. The tough prior negotiations notwithstanding, Southwest has a history of decent labor relations, and workers believe the company should stand up for them against the mandate. Telling pilots in particular to comply or face termination has backfired.

Meanwhile, Southwest has more flexibility than it has acknowledged. Federal contracts represent about 3 percent of its revenue, but even the Biden administration CANNOT alter existing contracts (please note, I have not checked this, though it seems reasonable); Southwest is only at risk of losing future contracts.
This pilot believes that the fact that the airlines received $25 billion in no-strings-attached cash for “payroll support” last year (as well another $25 billion in loans) has made them particularly reluctant to stand up to the Biden administration. Southwest’s CEO, Gary Kelly, may be in an especially tough spot since he is the head of the airline lobbying group.

Finally: This pilot says he loves Southwest and finds the crisis painful but feels that if this is the only way Americans can stand up to these mandates, then let the chips fall.

I can tell you, as a retired flight attendant, I have worked a few "work to rule' slow downs, they ARE effective. A glass (when we used to have glass) breaks in the galley...can't just clean it up at the gate. No, no, rug has be changed out, maintenance has to come, someone has to sign-off logbook, flight is delayed, crew goes illegal, etc,,, this is how it works. You are following the strictest interpretation of the FAA rules. I am beyond THRILLED to see these pilots do this. Selfishly, I don't want to fly with a blood clotting pilot. Sudafed used to be one of the few "allowed" meds- now a shot with UNKOWN substances and short/long term effects are perfectly fine? Hard pass. Even though I worked for a competing airline and still have flight benefits, I will gladly join their picket line if they strike. And I am not at all pro-union. Bodily autonomy HAS to be the red line.

I have faithfully served 33 years as an American Airlines pilot and flown over one million people safely all over the world. As an AA 787 Captain, I am threatened to be terminated on November 24th all because of a so-called mandate for a so-called vaccine. I have never felt so completely betrayed and am anxious to join my fellow pilots in this fight. Good for the brave, Southwest Airlines pilots! The Air Traffic Controllers are also in this war and standing up. Last night, they shut down Jacksonville Center by walking out while over 650 flights cancelled. The economic damage from the mandates will be massive!

I'm still in shock that this is happening in the United States.

Shows risks for younger people, while agreeing that for grandma and grandpa are the ones at risk, let's get them vaxed... but a mandate is not correct for the government to push...worth a listen.

Average death of a covid death is north of 80 years old, which is higher than the average life expectancy.

 

This is purely from my perspective, but almost everyone I know who had COVID and then took the vax got very sick. They all recovered, but some said it was worse than the COVID was.

I almost wonder if the vax and the natural immunity doesn't clash or something.

I think the same thing. It even makes sense why so many have vaccine injury after their second jab.

My DIL works for a mortuary... she said it is horrible how many family members tell her their loved one died after their second vaccine injection.
 
Love how they claim it is "weather" and "unexpected air traffic control" issues.

Once an airline is known to be on a work slowdown (strike) people will stop purchasing tickets.

As much as I dislike unions, they are asking for injunctive relief. The airline employees can't strike unless the union calls a strike. The union for Southwest, SWAPA, has a lawsuit:

The employees can't go on strike, but they can follow work rules to the T.

The vac mandate starts November ... employees know they will lose all their time off once they lose their jobs, so they are taking their allowed time off ALL AT ONCE- MANY EMPLOYEES.

It is also easy to cause slowdowns by doing everything by the rules. If that is done, crews will go over hours and can't take the last flight to position the plane to meet the next crew that is to take the flight. It is a mess once crews are not where flights/planes are.

When the crews are not helping get things going, the company is screwed.
